Seeds can not be patented

Companies like Monsanto claim to have paten rights on (Gentech) seeds. These patents are granted, but independent legal investigations proves that these these patents are granted on illegal/false grounds. Gentech whether it is 'organic' ore 'inorganic' seems to be not patentable because it will always be a modification to something that already exist.
